Water supply pipe to home has a leak. The water department is in the process of repairing. As a result of the leak my stone wall has collapsed. Is that covered by insurance?

Doubtful. Claims (all p&c) have to be 'sudden and accidental', and the policys typcially go on to exclude, 'gradual deterioration'...that being said, it doesn't cost anything to turn in a claim. I most certainly would.

This is where the ambiguous language of the insurance policy contract becomes a problem. The loss has to be sudden and accidental....well, it was sudden when you found it wasn't it? I have had many claims like this in Florida. Insurance company says the leakage was repeated and/or constant and therefore not covered. ....We take them to Legal, and we have a 100% success rate. File the claim, let it get denied and then file suit.

They will try to enter into some arbitrary argument about how the wall looks like it has been wet for some time. Problem is, the policy doesn't say how long is too long.

Some policies go on to say if the leak and or condensation has occurred for a period of 14 or more days its automatically excluded.....I say, let the insurance company try to show me what 14 day wet drywall looks like vs 17 day, 20 day or 30 day.

What is ambiguous about the above quote. Now we don't know the specifics - which happens here a lot...but for the few stone walls that I have been involved with that collapse water would have had to be gushing out to put pressure on the wall (which the OP would have seen) or it would have been leaking for a good period of time to loosen up the wall.

There is is...one of the PA phrases (100% successful..guarantee you 70% more money ! :roll: )I've been waiting for...PROVE IT...

I've NEVER seen a gradual deterioration claim reversed, NEVER...not is over 22 years..of course they have been qualified denials, claims that should've been denied. I've NEVER worked for a carrier that ''look'' to deny claims...rather they 'looked' for coverage to pay them.... I've also NEVER been an independent adjuster, and have only hired about twenty in that time frame, and ONLY because the claim was more than 100 miles away...
