Not accepting a total loss or salvage

I was rear-ended in my old '88 Chevy pickup. Damages were all cosmetic but to repair back to the pre-accident level will cost more than the ACV which means a total or salvage. I want neither since both will take my truck away or cause a salvage condition. Can I propose a less than total settlement offer and is the insurance company obligated to take it. The payout would be well below their total payout and the truck is not required to be repaired to remain road worthy.

Depending on your states guidelines, and the year of your vehicle. Not all states require carriers to report older vehicles as totaled, therefore they never receive a branded title (i know that MO and IA for sure)..

No they are in no way obligated to do this nor will they (most likely) and fact of the matter is, they can't...once a vehicle is deemed a total, it is supposed to stay that way..

The payout would be well below their total payout and the truck is not required to be repaired to remain road worthy.

All you can do is propose this...if they bite..good for you..but they are in no way obligated.
