My daughter, a minor at the time, was in a car accident. It was clearly her fault, as she rear ended a car. I had fallen behind on my monthly payments, but got them caught up. A cancellation notice was issued, but a month after her accident I got a letter saying our insurance was being reinstated back to the date of the cancellation. (along w/ $800 year increase) She recieved a letter from an attorney(that was representing the party she hit) saying she is being sued for $11k. The next week she & I both got letters saying our license was being suspended for no insurance. (me, being the owner & her being the driver) I called our insurance company and they said we did not have coverage when her accident occured. I told them I had the letter w/ the reinstatement effective date. They said they made a mistake and we didn't have coverage. The next morning an agent from my insurance company called & said "looks like we owe you money because we charged you for insurance when you didn't have any coverage." that was last week. Haven't heard anything since then, but I also have a car on the same policy that I have a loan on, so I called the leinholder about my insurance coverage. They said they were going to take out insurance because they had gotten a cancellation notice also, but then they got a letter reinstaing my coverage, so they didn't have to. They also said that my coverage has been continuious w/ no lapse in dates. HELP...I may lose my license and I'm being sued. Do I have any legal rights to go on so I don't lose my license? Can they legally go back to change effectice date of reinstatement 4 months later? Thank you

Let's start at the beginning...please help us help you by answering the following questions:
> What was the date your policy period ended?
> What was the date of loss?
> What was the date you paid your premium?
> When did you turn in the claim to your carrier?
> Did they send you a written denial ?
> What state are you in?

Once your lein holder discovers you have no coverage they will slap a HUGELY expensive coverage on your car and tack it on to your note, and it will ONLY cover you for collision and comp.
Your post isn't making sense to me, in a couple of regards...If you turned this claim in when it happened, or as soon afterward as possible, this claim would've been denied months ago..that makes me wonder if maybe you didn't turn it in?

my policy was from 01-15-09 to 01-15-10. I was making monthly pmts. , but fell behind by 6 weeks. This was at the end of april. I never was cancelled, but got a letter saying i might be. My daughter had her accident on 6-13-09. I only had liability and the insurance company was notified of the accident, but said they weren't sure they were going to cover it, since my payments were behind. I continued to make my monthly payments and got caught up. I was not aware that the person she hit was going to file a claim. I thought since I only had liability on her car, it was my loss. The car sat totaled at my house for a month. At the beginning of July, I got a letter saying my policy was being reinstated effective 04-30-09. (along w/ a $800 increase) I also noticed that I was still paying for insurance on the totaled car, so I called them. The person said she would take the car off of my policy. I still was not aware that the other party was filing a claim. No one said anything. Around the same time I got a letter from my credit union saying that they were taking out insurance on my other car, cuz they got notice of cancellation. The next month the credit union informed me that they didn't have to take out insurance cuz my policy had been reinstated by my original insurer. In October I recieved a notice saying my daughters & my license would be suspended(by WA. state) because of her accident that had a claim of $12k by the other party. Then we got a letter from the other persons attorney saying we were being sued for $12k. I called my insurance co. and thats when they said "oh ,we made a mistake in the date on the letter of reinstatement. you really didn't have insurance." I called my credit union to ask them. They said I have had my own continious coverage. They never had to take out insurance. I never knew the other party had a claim until their atty. contacted us. My insurance company knew of the accident the next day. I never recieved a written denial or cancellation.

Did the letter say (in essense) 'if we don't receive 'x' amount of money by 'x' date you will be cancel'? What were the dates, and amounts and when and how much did you pay?the insurance company was notified of the accident, but said they weren't sure they were going to cover it, since my payments were behind.
Someone/adjuster would've had to call you and/or your daughter and talk to you when the claim was reported. You say,the insurance company was notified of the accident
Who reported it? If not you or your daughter it had to be the other party...When they told you they didn't know if you had a policy or not (canceled for non-payment)...did they EVER send you a letter of denial?I was not aware that the person she hit was going to file a claim
Why wouldn't they? if the loss was your daughters fault, and the impact great enough to total your daughters car, then they most certainly would've had damage.I thought since I only had liability on her car, it was my loss
Your daughters car is..but the liability portion takes care of the other vehicle (and their injuries)..

This is a different car, and will have no bearing on your claim. Do you have a letter from your carrier that says the policy on your daughters car was reinstated without a lapse in coverage?My insurance company knew of the accident the next day.
Who reported it? Who has denied this claim, (on the phone)? An agent cannot deny a claim..I never recieved a written denial or cancellation
Well, you kind of did, (i think) what EXACTLY did that first letter say?I never was cancelled, but got a letter saying i might be
