I live in tx and have an insurance check

I have an insurance check from last spring, truck got repoed about a month ago(they wouldnt put check towards payments due just towards the balance). Tough times hit in the oilfield and could really use the 1300 dollar check for x mas for the kids. the check currently has my name and the old lienholders name on it. the old lienholder doesnt have the truck since they already sent me a deficciency letter stating that they have sold the truck at auction(therefore they no longer own it either. What is the best way to go about getting the money?Any informative input is appreciated.

You could always explain the situation to your adjuster and have his opinion regarding this. It can't be that your carrier has to wash off their hands simply because they've dispatched the check. I'm sure our senior members would be here to tell you whether you'd need to get in touch with the current owner of the truck.

Well, there's no (legal) way for you to get that money..you don't have it coming...I'd bet your lein holder was paid this when they repo'd your truck..they most likely contacted your carrier about this damage, your carrier more than likely stopped pay on the draft you have, and reissued directly to your lein holder.

The only thing I could recommend trying is call the adjuster tell them you no longer have the vehicle, (they can run a title search to see it's been sold)...and ask if they can reissue this to you only...don't get your hopes up though...

Sorry about your rough time..it will get better...it always does...hang in there.
