stolen car recovered and file already turned into total loss

Hi, my car (only 2 years old) was stolen and the insurance company told me that after 14 days, they'll turn it into the total loss dept and pay me the value of the car. When the car is recovered, they'll retain the car. Total loss rep already quoted me an ACV over the phone, then the car is found. It's been 20 days since the loss. The condition of the car is unknown at the police dept. Should we still have the rights to choose the cash settlement to get a new car rather than having the insurance company restore it since it's been gone for so long. Who knows what kind of hidden damages are buried.

If the payment on the claim has not been made the insurance company will determine if the vehicle is repairable or not and proceed accordingly. You should not have a choice in the matter.
