Total Loss Question

Hi All, I had a Total Loss question I was hoping you could help me with. I was recently in an accident, and my motorcycle was a total loss.

The other drivers insurance company, who is 100% liable, has proposed a settlement $ offer, but it is undervalued. Basically, I made over $1000 worth of additions to the bike since it was purchased. I got a brand new fork, body panels, seat, battery and more, and I want this added value to be considered in the total loss value.

They say NO. They claim that "the work I had done does not add value to the bike, as these items are needed in order for it to be operational." (direct quote). This doesnt seem right? It seems these improvements should count for something since I could sell for more with these upgrades.

Is this true? Any advice here would be super helpful.

Under circumstances when it's not possible to get your dispute conveyed to appraisal, you have only one option - litigation. You may contact a small claims court or a Justice court in your locality and that would probably be cost effective.
