Agreeing on a Medical Settlement

I was rear ended on the highway about a month and a half ago by another driver. I was stopped and he was going about 40 mph and was given a ticket by police. The cost of repairs to my car are approaching $9,000. I went to the ER and have been to the doctor 3 times and a physical therapist once.

Since he was found at fault they have been paying to repair my car and just offered me a $800 settlement for medical which I feel to be a little low. My medical costs are at about $1600 but all covered by insurance. I had pretty severe back pain for a month and lingering the past 2 weeks. What would be a fair counter offer and what final settlement value would be fair to expect in this situation?

I don't think you should hurry to arrive at a settlement at this juncture. You should wait more and be sure of the total cost of treatment. Something might still cause problems or add to further visits to your doctor.
