we were rear ended will stopped at a red light and my son let his insurance lapse. there is damage to his car but not the car that hit us. when i called his insurance he still hadnt put in a claim.we live in california. i understand that my son needs to get his insurance back but because we were rear ended at stop light the person who hit us is totally responsible.....correct

I'm pretty sure CA is a no pay, no play state. This means you son can _only_ collect for his econimically losses. This is the damage to his vehicle as well as any medical bills. If he was injured he cannot collect for his pain and suffering.
Are you sure the other person did not let their policy lapse and that they were not driving around without insurance to address the loss of the person they hit? Because that just would not be right. :wink:
