Prudential in California is saying I can not get a prorated

My policies is paid thru June of 2010. I have purchased a new policy and now they are saying I am not due any refund because CA is not a prorating state. This seems illegal to me.

Did you consult with your agent prior to your purchase? Please go through your policy papers and tell me if you come across any clauses that depict such a refund. I didn't come across such a problem before.
