my car was keyed and broken into and i filed a police report and contacted my insurance company about the incident. A week after the damage the finance ompany came to get my car and it was only two payments behind and in the repair shop but the finance company demanded i return the car asap or they would have me arrested so i went and got the car and contacted the finance company. Two and a half weeks later the finance company contacted me and wanted me to give them the money i recieved form my insurance company, what do i do?

First, if there was a lien, your insurance company should be obligated to protect your lien holders interest in making the check payable to you and the lien holder or you and the repair shop. They did not do this? Someone should have told your carrier that there was a lien on the vehicle.
Are you asking if you are obligated to pay your lien holder for the damage to the vehicle? Well, you'd have to read you contract with the lien holder but I'm betting you are. If you did not pay them, they could seek recovery for the damage to the vehicle in addition to what you still owe. If they would do this is up to them.

yeah and i was only two payments behind with one in the mail but i STILL dont understand how they could demand me to bring the car to them or i would be arrested, while it was getting fixed and then try to make me return the remainder of the insurance money after i paid the guy that was in the process of fixing my car. My lawyer states they are screwed im just tryin to gain second opinions. THANK YOU!

My advice to the poster. Contact a free legal aid attorney if you're so broke you can't afford to make your payments. I'm not sure whether the insurance company has a valid claim against your damages check, but you need legal advice...not usually found in an insurance forum.

you definitely should find some decent legal advice because you need to have clarity in your case.
You might want to search on Google for "free legal advice" or "free legal advice" + YOUR CITY and check if something shows up.
