i was hit by a vehicle (auto-ped. accident)
The lady who hit me said she had insurance. I was assigned a claims adjuster but later there was a letter given saying the policy had been cancelled on a certain month & day. On a previous random phone call it was told by the insurance company that the policy was cancelled two months before the date mentioned in their letter. The lady insists that she had coverage and that her policy is still in force. I have researched this company to find they had been fined, not only in MO. where this accident happened but also in IN for not properly handling claims. Is there an agency in Missouri that can verify if she indeed was covered or not?

Did you get this call prior to the date when you got the claims adjuster assigned?

The lady insists that she had coverage and that her policy is still in force.


What does she say regarding your claim, now that her insurer is denying?

the insurance company rep from the phone call said cancelled in July, but the letter, which came later, stated a cancellation in May, making two calander months later than stated in the letter

If she's still covered then I'm sure she's writing checks towards her premium payment with this insurer. Is she still receiving her bills/statements in time?

Ask her to show it to you or your attorney, as this could be a valid proof. Otherwise her claim that she's still covered doesn't hold good. How's your attorney planning to pursue this case? Has he shared anything with you regarding his course of action?

That is what I am thinking. I am requesting my atty deal with the dept. of rev. in the state of MO. Insurance companies have to update their files & send an update once a month.

You are on the right track, although I'm not sure you have to spend a bunch on attorney fees. I'm not familiar with MO, but MT has a State Auditor who also acts as State Insurance Commissioner. They generally are great about following all threads of an investigation and keeping you in the loop.

You need an attorney to sort this out. Since the lady claims to have a proper insurance, ask her to produce some proofs of the same.
