If a person changes a beneficiary based on marriage then discovers the marriage is not lawful because they never divorced in the pass will it annull the second said beneficiary or can they claim the benefits or will the first named claim ?

I guess you should just speak with your insurance company. If you are the owner of the policy, you can make anyone a beneficiary in a life policy. If there is a mistake in filling out the form, simply talk to your insurer and explain the situation. If you need to make a change, co ordinate with them to do so. I don't think it will be a problem. Then, anybody you want can claim from your policy.

It is always the holder of the policy who decides his beneficiary. You can just change the beneficiary here. That would easily solve the problem.
