Location Huntington Beach, CA. My son is married and we still carry his car insurance. He lives in Moorpark, Ca. Can I still carry him if the car does not reside with us. Car is registered to him. Someone told me its insurance fraud?? and if he is in an accident the company can deny coverage

Is your son listed on your policy and does the carrier know the garage location of the vehicle? If so, I see nothing wrong with this.
The only "problem" I see is that you may not have an insurance interest in the vehicle. That is, if the vehicle were to vanish, would you suffer some type of loss? Did you buy the car for him, did you finance it, would you need to replace it if it was missing, etc.?
I'm also guessing his wife has access to the vehicle. Is she listed on your policy also? If not, then this is a big problem as she may not be treated as an insured under your policy if she is in an accident (as the car is available for her use and is not listed on the policy).
In all, this is really not a good situation if you don't own the vehicle and they are not living with you. Your son or his wife really needs to insure the vehicle. You can feel free to pay their bill, though.

Was your son part of your household when you listed him on your car insurance policy?
If not, then this is a big problem as she may not be treated as an insured under your policy if she is in an accident
I agree with tcope. His wife cannot be covered by this policy.

Veronica honey, that's NOT what T said, he DID sayproblem as she may not be treated as an insured under your policy if she is in an accident (as the car is available for her use and is not listed on the policy
However, if she had permission, she would most likely be covered..Boy, any other state, I would'nt worry too much about (my own) opinion on...But CA has some 'funny' insurance laws...
Couple of questions...is your boy listed as 'married' on the policy? (he should be that usually drops a males rates, a little atleast in my state)...as T said, what is the garaging address for this vehicle? Is this a newly aquired vehicle? meaning did he buy/add this vehicle AFTER he'd already moved out and married, or was it added prior then he moved and married?
The safest thing would be to contact your agent...see what they have to say about this. I had my kids cars listed on my policy for years..my 31 yr old daughters STILL is...the carrier knows, and there is no issue..but again the difference between MO and CA is HUGE.. :wink:

I'd say there is a good possibility that she would not be considered an insured as there is an exclusion for vehicles you have access to. This very well could be a company to company 'thing' as to how these types of claims (if and when they arrise) are handled...The carriers I work(ed) for have NEVER denied coverage. They have though added the unlisted driver to the policy, if additional premium is charged to the policy then it is. I've personal never seen them denied.Add your comment
