Can a woman voluntarily take herself off her husbands health insurance if it is not Open Enrollment? He has been abusive and I am trying to start over and get out from underneath him. The divorce is not final yet either. What can I do to get off of his insurance? That is one more thing he has control over me at this time and I want that stopped.

Why don't you call up the Dept. of Labor? I'm sure they'd be able to offer you the right information regarding health plan functions and the associated laws. The number is (800) 998-7542.

Contact your insurance company as they will be able to provide you all the details. You must also go through the terms and conditions of your policy.

Under normal circumstances, you cannot change a policy until term or open enrollment. However, in your case that maybe different. It may require the divorce to be finalized or you may have to obtain a court order
to submit to the insurance company.
