Rear-end collision

I was involved in a rear end collision where a semi slammed into a pick-up which slammed into me. My car was brand new (10 days old). Semi was at fault and have been trying to work with their insurance co. Sustained minor neck injury. Semi's insurance is trying to settle injury claim for $500 and give me $600 for diminished value of my new $28.5K Accord which has 700 miles.The insurance company is rude and doesn't seem to want to resolve this. What is fair to ask for and should I seek Legal Council to resolve?

How long ago was this accident? You said "minor" neck injury, are you still being treated? How long was your treatment? What was the treatment? What perscriptions were you perscribed? Are you working? Miss any work? What is the total of your medical bills? No one can give advice on what to ask for.

That is crazy! They are trying to low ball you. Get a lawyer that will represent you and they would get their fees if they win. It is a win/win case. Make sure you ask for time that you have lost from being away from work and being away due to doctors visit and inconvenience and all that. Insurance is a necessary evil and they love you when they are getting money but when they have to pay a claim, they are the worst to work with.

OP,..you're saying this person rear-ended YOU? I thought, when someone rear-ends someone else, it's automatically the fault of the vehicle that rear-ended you. How can you 'go after' the FIRST vehicle when he didn't touch you?

I think "Assumed" would be more accurate than automatically

As for only the person that actually makes contact being the only one at-fault.... I'm not so sure.

Let's say your standing near the top of a long set of steps talking to your friend who's on the top step, and I run over to the steps and knock your friend into you and you tumble down the steps receiving multiple injuries, but your friend is able to grab the rail and not fall. Should your friend be responsible for your falling or Me??

FK...I see your point. If the FIRST car didn't hit the SECOND car, the rear-ending of the THIRD would have never happened (I think I'm 'summing' this up corrrectly..). Ok.......this is a 'third party' thing, then? The OP can go after the driver in the FIRST car??
