How do we get fair value for our "totalled" car???

by runriley » Sun Mar 21, 2010 01:37 pm

We had our 2004 Malibu rammed in a parking lot by a driver who hit the accelerator instead of the brake. Our car was legally parked with the parking brake on. Our car was slammed into the vechicle parked next to it, and up into the front curb. It has damage to 3 sides as a result. The car next to it has an estimate of $3,000.00 to repair. We know from that information our repairs will be high. This was 5 days ago. We have no estimate yet, nor a rental car. We have Travellers and the at fault driver has Allstate. Travellers is requiring that we drive miles to pick up the rental car, which we do not understand, and have not returned our calls. My daughter was at work and it is miles from our home. Needless to say we are very disappointed with the service from our agency.
Our car was in very good condition before this, with moderate mileage. Now we are worried that we will not be able to replace this vechicle with an equivalent car with the money offered. I feel that we are the damaged party here, and things are being made very inconvienent for us. Any advice please??? Thank you.

Are there no rental companies near you that would bring the car to you?

Thay have already made an offer? No estimate? Do you know what the ACV (actual cash value) of your vehicle is?

Give me some info- year, model, mileage, options and I will run a value for you.

Start calling both carriers (claims depts) daily...ask what's going on...it's possible that Allstate doesn't have your information.

You will most likely have the choice of which carrier to use, the at fault party or your own. Assuming there are no PD issues with the at fault party.

An 04 Malibu with damage to three sides, is going to run a good chance of totaling, you're right...but I'd not get to worried about that until you talk with someone.

Where is your car now? I'm assuming it's been towed from the accident scene? Who towed it? You must've talked with Travelers at some point, in order for them to set up the rental...What did they say, re: when someone would be to look at your car? How far are you from a rental car company? Are they using Hertz or Enterprise?
I'm with Trench we need more info to help you. Please provide same.

The car was towed to Automotive Tech which has a Travelers concierge. We were to have heard about the damages on Fri. but we didn't. Our claims adjuster though t it may be totalled, then it goes to a total loss adjuster. We live in Silver Spring MD car was in Luthersville Md. Was towed to Randallstown, where they want us to pick up rental car. We don't understand why, but our calls have not been returned as of yet.

research the same make, model, miles etc. To see what one can be purchased for in MD. Check out autotrader.com or cars.com. Should give you an idea of what an offer might look like.
