In Texas, will I be covered by my insurance in scenario:

In Texas, I had a young man that does some work for me take my car (to what I thought was just a few blocks away) to detail the car. He ended up having a major collision and probably totalling my car as well as a stolen vehicle which was stranded on the roadside (he reported to me a third vehicle cut across two lanes trying to make an exit, forcing him off the road into the other vehicle). I have yet to see a police report, but the driver and his girlfriend were taken to the emergency room and are okay, and the cars were towed to the wreck yard, so I'm assuming some sort of police report was made. Also, he admitted he let his unlicensed girlfriend drive the car, as his had been suspended. I carry full-coverage on my vehicle, what can I expect from my insurance company considering these circumstances?

Is it just me who sees the flaw in this "logic"? :?

If you have collision coverage, your carrier will pay for the damage to your vehicle and address any liability that may be involved. You will be subject to your deductible. Your carrier probably won't seek recovery as the driver would b considered an insured under your policy. However, you should be able to recover your deductible from the driver. However, I doubt this person will ever just hand over that money. You'd probably need to file suit and _if_ you won, you'd have a nice piece of paper called a judgment. You'd then need to seek payment. Basically, I'd file with your carrier, pay the deductible out of your pocket and see if the detailer or driver would pay anything to you to address your deductible. Take what you can get and call it a day.
