Hit & Run in NY

I was involved in a hit and run. the car who hit me ran away. how do i recover the damages from the insurance company. we have a police report & license plate number of the car that ran off. Can we sue the cars insurer for damage if they dont pay the claim?

I'm hoping that the police investigate this and list the other parties information on the PR. Did they do this? You need to find out if the other party has insurance. I can tell you from experience that a vast majority of people hit hit/run do so as they don't have insurance.

Do you have collision coverage. If so, you can file a claim under your own policy and your carrier can seek recovery. I don't recall if it is NY or NJ but I think one has UMPD... uninsured motorist property damage. You need to ask your carrier about this.

You don't sue the other person's carrier as they did no cause you the loss. You'd sue the other person who cause the damage. Suing someone gets you a nice piece of paper called a judgment... it's not like the person hands over the money at the end of the trial. This then allows you legally to pursue recovery from the other person. You can attach a lien to certain real property that the person might own, you _might_ be able to garnish wages, etc. You would need to file in court to get all of this done. In other words, it's much more difficult them people think to collect in court.

Contact your carrier to see what coverage you have. Follow up with the PD for info on the other party.
