Can I make a claim on liability insurance?

I was the passenger of the car who got hit from behind by another vehicle. The at fault car has no insurance coverage. The car I was riding in only has liability insurance. I was injured in the accident. Who do i make a claim with for my injuries? We live in Central California.

If the vehicle you were riding in has UM (uninsured motorist coverage) then that coverage would apply to your injuries. Most states require UM coverage, but it doesn't look like CA does.

Minimum liability insurance requirements for private passenger vehicles (California Insurance Code §11580.1b)
$15,000 for injury/death to one person.
$30,000 for injury/death to more than one person.
$5,000 for damage to property.



So, if the vehicle that hit you is uninsured, and the vehicle you were in does not have uninsured motorist coverage, then you have one option left...If you have a vehicle (or your parents/spouse etc), that has UM then it would kick in for your injury...If none of these are available then your only recourse is to sue the at fault party, get a judgement, (which will be easy) then try to collect on the judgement, (this will be hard) since the at fault party didn't have enough money to buy insurance they likely can't satisfy a judgement either...

If the car you were riding in has Med Pay Coverage you may have your medical Bills paid by that coverage.
