getting a fair deal for my total loss

by priscillaobregon » Thu Apr 08, 2010 06:04 am

i was in an accident on 3/16/10 and they said my car was a total loss but their CCC one report say my car is only worth 1,971 but in KBB and NADA say my car is worth about 4800.00 for excellent but 3500 for average wear a tear. I don't want to settle for peanuts what do I do to get a fair deal

First check the CCC evaluation closely, make sure all information (about your vehicle) is correct, ie model, mileage, options etc.

Then it's up to you to prove them wrong..nada and kbb won't do it...call the comps they have listed, see if they are truely comps..call some local dealers be truthful about your vehicle and it's condition, seconds before impact..see what they would ask/sell your vehicle for.

Did your vehicle have ANY condition issues? such as interior damage, prior unrepaired damage?

Is this your carrier or a different (at fault) carrier you're dealing with?

it's Canal Ins the at fault carrier...and no there CCC one report doesn't have all the options that my car has.... so I'll start calling around local dealers and asking to see what they say.... what about personal property damage: we 'were pulling a trailer with our household items when a Semi hit us three times totalling our trailer there was some stuff that can't be replaced like pictures that belonged to father how do I claim things like that.... and to replace the damaged stuff is about 5335.00 how would the ins comp determine the value of my stuff

Was this trailer also insured? If not, your home owners policy may cover these items. You would need to read your policy to see what is and what isn't.

No Trench, honey, I think you misread it..it's a liability claim...The 'at fault' semi's carrier is handling the OP's loss

it's Canal Ins the at fault carrier

Unless you meant, she could look for coverage there as well? :?

OK, the semi carrier (Canal ins..I think you said) will also owe you the ACV (actual cash value) of your trailer..as well as any and all personal property damaged.

there was some stuff that can't be replaced like pictures that belonged to father how do I claim things like that....

Well, they can't pay you for the sentimental loss unfortunately...we can't put a price on that...by pictures I'm not sure if you are talking about photographs or art work...either way they will owe you the ACV of those things as well..

Now, remember they will owe you the ACV not the replacement cost in most instances...

a Semi hit us three times

Holy Moly Girl  you're lucky to be alive..did anyone get hurt?

What kind of car, and trailer did you have? Has the adjuster asked you for a list of your personal property? What are they doing about the trailer?
