Can I sue the car insurance company in VA?

In Jan. '07 I was rear ended in a Pontaic Grand Am by a young man driving an SUV. This young man has a history of speeding tickets and had another accident in July '07. I have had 5 surgeries and countless Physical Therapy sessions. I have followed my doctors orders to the T. Every surgery was suppoerted by MRI approved by my health insurance company. (Which in turn notified me that the injuries were a result of an automobile accident and put a lein agnaist my case.) I have exshauseted my savings, my childern's savings, and am know permenately disabled and am in a state of constent pain. Even with all this his insurance company has refused to make a reasonable offer. Can I sue them in the state of VA? Do I sue them while I am sueing this young man and his insurance coverage? Do I wait until I am awarded damages and sue them for all the additonal exspenses incurred as a result of trial? Do I really have to pay my health insurance back after paying $15,000 in out of pocket exspenses and more then that in premuims monthly? I can't beleive I did nothing wrong and have suffered so much to end up turning the money over to the health insurance companies who have already collected so much.

You file suit against the driver and/or owner of the other vehicle. Given the extent of your medical bills, this probably takes you well out of the realm of small claims court. As such, you'd need an attorney. Your attorney can address all of your questions.

You probably do need to pay your health carrier back but you can always negotiate the amount owed. Your attorney would handle this as well.
