REAR ENDED by non insured Person

HI a lady rear ended me and me real nervous about my 2yr old daugther well being didn't know what to do so the other lady offer t for us to exchange information, was real nervous I didn't know what to do so we exchange info but whe she was leaving the scene something told me to looked up and write down her plate # so i did so minutes after when I was more calm i try to leave the scene and my car wouln'dt start so i called my dad and he call the police because he didn't want me to leave the scene with out making a police report ... but now her insurance is telling me that she wasn't covered at that time that her policy was cancelled the month before .... what can i do now since that day of the accident i'been having head aches and I was seen by a doctor now i have that medical bill and my car is damage?

Do you have collision coverage, do you have Uninsured motorist Property Damage, do you have Uninsured Motorist Bodily Injury coverage, are you in a PIP/med pay state? All of these are coverage under your policy which would address your situation.

You need to let the police dept know that this person did not have insurance at the time of the accident.

Have you contacted this person to see if she obtained other insurance?

You should also see about reporting this information to the state (I'm not sure who would take this information but your states Dept of Insurance can assist. Many states will suspend the person's drivers license until they can show that they settled our loss.

If nothing else, you can file in small claims court for your loss. This does not guarantee you anything but it might help.

first of all thanks for your answer ,....but unfourtunally I only have libility isurance so it won't cover me at all, and I try callng the lady to see what she wants to do before trying anything else but she don't answer at all ....I'm guessing thats why she wanted to leave the scene instead of calling the police right away and another thing the police is the one that gave me her policy # and fisical address because she only provided me with her name , p.o. box phone # and insurance name.

I would recommend contacting your local Department of Public Safety or Department of Motor Vehicle office (where you obtained your drivers license). Depending on the state you live in, the name may be different. Many times, they can advise you what would be required to get a judgment against the uninsured driver, and if the state law allows, have their license suspended until they reimburse you for your expenses.
