I was stopped at a red light when a person ran into the back

I live in Michigan. I came to a red light and stoopped. After a few seconds I looked into my mirror and saw a woman going fast and it looked as if she was on a cell phone. She rear ended me. I did not hit the car in front of me but I called 911, reported the accident and filed a police report. I have all her inf. she said she would pay for it. She had me take it to her collision shop. The guy ordered the parts. The guy told me to bring in my car and they would repair it. I did not go to the repair shop because the other person doesnt want to pay now. The woman who hit me called and said she changed her mind and did not want to pay for it. I dont want my insurance involved. I have broad collision her insurance wont pay my $500. deductible because of it. Broad Collision. What can I do? The person who hit me and was at fault wont answer my calls. What to do? I may going to court?

You can't do anything. You can go to court and be prepared to have it thrown out in 2 seconds and you'd loose your fees.

You live in MI. When you chose insurance you elected to have broad form coverage. You should have known MI is a no-fault state when it comes to property damage.

I have not looked in awhile but I thought broad form meant you could only collect your deductible from the other person's carrier.

I tend to agree with tcope, you should be able to collect your deductible from the at-fault party or their insurer. But no fault means your damages are paid for by your insurer, the other driver's damages by theirs.

If the insurer refuses to pony up the money, you can take your matter to small claims court. If you win, the at-fault party or their insurer will have to pay the claim for the deductible, but not for the remaining cost to repair the damage to your vehicle.
