how can i get reinburst from agent

how can i get reinburst for a carrental that was issued to me through my agent even though the car wasnot in shop.i did tell the agent it wasnt in shop and he said it was ok cause i have coverage for rental.because he hought the other insurance was going to pay for it,but after two weeks claim was denied from other party.how can i get money back from agent

Sue him or her.

Or ask the agent for the money and see if they comply.

i did ask the agent for money back and he said that ,that was not his fault that he was going to sleep on it.now my bank has over draft fees for a rental the ins.company said i could use cause it would be coverd by other ins.

April provided a little more information in a pm to me (see below)

here is the story ,i was in an accident the other car hit me on side,we exchanged info ,i called police made a report other vehicle did not make a report so i made a claim to their ins. and i called my ins and gave police report,well it all came out to be other person fault due to accident report.so my ins.agent set a rental car for me cause i have collision ,so .at this time i still have rental i went to agent to speak to him about status on my claim and they said havent heard anything from them yet ,so i asked him should i turn rental in cause i did tell him that at this point my car was not in shop , due to the adjuster from other ins.he came four days later to see car .so at that point i did tell him since my car was not in shop do i turn car in because i was not going to pay the rental fee,and he (agent) and other ins.worker who was their said you can keep it cause you do have car rental for so long and so i did cause they said.well it turned out i had rental for two weeks and when i kept calling to see what other ins.was going to be responsible they denied claim and i had to pay 695$ noone told me .can you help me what should i do at this point

First of all April, this was your "agent" the one you purchased the insurance from is that correct? :x

The way this should've worked is your agent turned the claim into your carriers claims dept. No adjuster I know would allow an insured to be in a rental without going forward with the claim (ie either repairing or getting the total loss settled). Typcially you don't get to keep the rental just because you have say 30.00 a day up to 30 days coverage. And frankly your agent is an idiot if he/she told you this, and need a good slapping.. Policy language differs, so check this first. Read your policy regarding this coverage, see what conditions are there, then post them if you don't understand them..

Answer a few questions and lets see if we can be of some assistance to you..

Why did the other carrier deny your claim? Has your company stepped in and settled the damages to your vehicle under your collision coverage? If not why? Have you actually talked to an adjuster from your company? If not why? What state are you in?

Are you flippin' kidding me? This statement makes me think it is an agent, NO adjuster would say this...I think what's happened here, (and I've seen it too many times)...loss reported to (captive) agent...agent decides not his ins. fault, doesn't want to turn in the claim, because he doesn't want it to affect his loss ratio :roll: :evil: so he slides you into a rental, (still without turning in the claim), figuring the claimant carrier will pick it up...(still not reporting the claim to his company thereby not having any reserves set up :roll: ) other carrier denies claim (maybe lapsed policy?) and now you're the one in the mess...

Answer my questions and we'll see what we can do. I don't know any state that allows ANY agent to deny ANY claim, which is exactly what he's doing...I think you have him over a barrell, but again, more info is needed...
