What is the authority, statute, regulation etc... upon which carriers have a duty to place non-fault party in a rental until 3 days after a reasonable/fair offer. From NY

There is no requirement for this. Case law would govern how long a rental is owed. In most states this is until the insurance company makes an offer.

Check with your states Dept of ins web site...most will tell you a rental (even one day) is not legally required. Also check with your own carrier.

There is an obvious reason that carriers put a limit on this (written into most first party contracts I've read). Person totals their 1999escort, an offer of settlement is made, but they enjoy driving that 2010 camry for free...now why would they want to hurry to find another vehicle. I'm not saying it would even occur to you, but believe me there are plenty that would. Hense the limit post 'offer' most carriers have adopted.
