Potentially. Who is the beneficiary in the life insurance policy?

If there is no beneficiary at the moment because no others were listed the default is usually his estate. But with some additional language concerning payments to him in a decree, it's possible an attorney on her estate's behalf could argue this.

This will likely depend on how much money we're talking about. The larger the amount, the more motivation her heirs may have in ensuring this is part of her estate.

the will says it goes to the estate but she is listed as the beneficiary to the estate. but she is long dead now and the death just happened to the man
i assume she was listed as the beneficiary. not sure if there is a secondary or not wouldn't suprise me though she and her family are all about the money

How old is the Will and Divorce Decree? Depending on age it may be contestable. This is going to take attorneys and lots of money if you choose this route.
