Uninsured motorist accident

Hello. I was hit by an uninsured motorist who is an acquaintance(Texas). At the time she represented that she had liability insurance. Initially I did not file a police report (yes stupid) she took responsibility and I had witnesses. But now that I found out she does not have insurance she is refusing to even take my phone calls. The damage is over $1,000 threshold, my insurance will pay but I feel like she should have some consequences for hitting me uninsured. Other than suing her for my deductible is there anything I can do.

You should turn to your insurance company for the repairs, sue your "acquaintance" for the deductible you will have fronted out of pocket, and report the accident to the Texas DMV. She'll reap the consequences of her failure to obtain the required insurance.

Perhaps you have "uninsured motorist" coverage that will waive the deductible and pay for the repairs, in which case you would not be able to sue. But your insurance company can sue her for its loss. And it would probably win.
