Insurance

I was in a car accident and the party took me to court to fight the case because she got the ticket. I won the case and the judge found her guilty for the accident. Now I get a call from my lawyer telling me that he was advised that her insurance will not pay nothing and he thinks that it is best for me to drop the case and I walk away with nothing. I advised that I would have to call him back on that. I feel that her insurance should pay because the judge found her guilty as charged and she did get the ticket.

Look, just because the judge said that this person was guilty of causing the accident...does NOT mean that this person is automatically responsible for ALL of your damage(s) and injury. As an example...let's say you roll into the back of my car moving 2mph..You were wrong..no question, you are at fault for the accident. But, now I'm claiming 10k in damage to my vehicle, as well as 50k in the horrific injury you caused...See my point? Yes, (in my example) you were at fault for the accident, and legally responsible for any damages you caused...but NOT legally responsible for EVERYTHING.


What is it you are claiming? What is the reason for their denial? Was there no damage to the vehicles? Just because there is impact between two objects does not mean the innocent party is due ANY money..

They should pay you for what? and how much?

There is a reason that this carrier told your lawyer they are not willing to pay 'nothing'...(which is odd)..and they HAVE to give the reason for this denial..furthermore, your own attorney says you don't have a case!
