accident claim

I had an accident in DEC 09 and now the adjuster is doing an EUO. after all the interviews, they claim that me and my friends stories did not match. they are saying that my description of the accident was different from my friends. now after the driver had his EUO done, his lawyer said he is thinking of canceling his claim. my lawyer said if am not guilty than I do not need to drop the case. my life is on the line now. the driver has a past history of accident claim, and their main focus is on him. anyway we were hit by a stolen car and the driver run away after. am seriously hurt ans so is my friends.

To me that can only mean one thing (and yes, I've seen this many many many times) he got caught lying and he knows it, and he also knows he's better off cutting his losses and running!

Which futher proves my point, the driver is/was lying, and got caught..What did he lie about?

my life is on the line now.

That's a little mello dramatic don't cha think? No one is going to kill you, nor are you going to die from this...

That doesn't matter, unless he lied/commited fraud another time as well, again, what did he lie about? And did you back up this lie?

yeah, you've posted this issue before...and again, if you want help you need to answer the questions I've asked.

Was this a 'staged' accident? Sounds like it...what was the driver (your boyfriend right?) lying about? What are your terrible injuries? Have you or your friends EVER been in an auto accident before?

no, I have never been in an accident, neither has any of my friends. it was not stage. he was my boyfriend, now my ex. when they show the pictures of the car damage it was it looks like the car hit us twice. my door was jam, and my right side is killing. he said he did not lie about anything. all that they told him was that our description of the accident does not match. my lawyer described the accident as a T-bone and my they described it as rear-entry. am almost done with my nursing education and I have a child to take care of.

Your ex boyfriend, would not even be thinking of withdrawing his claim, unless they have him dead to rights on something...also the damage to his vehicle will speak to the impacts, that is also no reason to deny a claim, wrecks happen in a split second. No way a carrier will deny a claim because of this..

You said your ex had been in accident(s) before, what were those about? Aren't you pursuing a claim with your own carrier for UM, or are you pursueing his carrier with this claim or both?

he said he was in the car with his mother, and his mother claim it , so it was not him, it was his mother. I don't know what it was all about. I am claiming it on my own insurance and not on his insurance. it just that he has the same carrier as me, so now they change my adjuster to his adjuster. now what should I do, should I tell my lawyer about how it went with my ex or should I with draw?

Withdraw if you lied. don't withdraw if you didn't..it's that simple...

so he said or agreed that his mother was in the car but she was not? Is that right?

he and his mother were in a car some years back and he was in the car with his mother. therefore when his mother claimed for the benefit he was included because he was in the car as well. I do not want to have a bad name or stress in my life. I did not lie about anything. his lawyer said the way he was shaking when they started asking him about his personal life, they thought he was lying about something. they believe the accident happened, but his personal life stories, that is were they think he is lying about. true to God am almost done my nursing school and do not need this stress. If I should withdraw, will I be asked to pay the money back or will they sue me? do I have to pay all the therapy money back as well, I have not spent a dime of their check they issued to me. I can give it back to them if they want. Am not guilt, I was a passenger and I don't know anything.

Then don't worry about it...let the claim resolve when it's time to resolve it.

thank u for your help, u have been of great help for me so far. I will keep u posted. Also my lawyer said we should submit everything just to prove my point. and that if anything should happened, the driver will be the one at fault. also one of the most confusing thing is that the way the accident happened that we described is contradicting the police drawing of how the accident happen and that is also confusing them as well. I believe police officer can also make mistake. they said they need my school record and grade's, my health record for 10 years, but my lawyer will submit one year, they want my daughter birth certificate and daycare attendance, my phone record, therapy attendant and etc. are they allowed to have all this in-formations? and what are they trying to prove?

They are certainly allowed to request this information...Run EVERYTHING by your attorney that's what you're paying him this whopping 33.3% of YOUR settlement for...make him earn some of it...even it's only by answer questions...
