I was in an automobile accident where it was the other drivers fault. My two children and i were injured and seen at the hospital.my kids ended up being ok but they said i have whiplash and now i've been seeing a chiropractor twice a week. i have had neck pain and i get headaches. there insurance company said my vehicle was totaled and they offered me an amount that i dont think is fair. the amount they are offering me will not get me into a reliable vehicle. what can i do? also they told me that since they offered me the money they will no longer pay for a rental car. i have no other vehicle and i dont understand this whole mess. i just want them to fix my car or get me the same car. i feel like its a cop out on there part for not fixing my vehicle because they say its to expensive. it was there persons fault and i feel as though they should be responsible for either fixing my car or getting me a reasonable amount so i can buy a car.

The amount offered is the ACV (actual cash value) of your vehicle. Or what would be acceptable to purchase your car in the condition it was before your accident. This is all they are obligated to offer you. What can you do? You can research if this offer is accurate by locating a vehicle(s) in your area that are in similar conditions as your vehicle is to see if the offer is valid.

If you have accepted the offer, of course they will not continue paying for the rental. If you have not accepted the offer, they will give an expiration date of when the rental will be terminated.

If the dollar amount to repair the vehicle exceeds the ACV or current market value, it makes no sense to repair it.

As previously mentioned, the insurance company is accepting the responsibility of their insured. They are offering you the value of your vehicle before the accident occured. If this amount is equal to the ACV of your vehicle, then that would be reasonable.
