I live in Colorado, and had a slip and fall back a few months ago. My lawyer had put in a demand to the insurance adjuster almost two months ago, and has not recieved a response yet. Would he be awarded the full amont in a certain amout of time?

Not sure what you mean by this..do you mean after a certain amount of time would the adjuster just automatically give him what he demanded or the policy limits? no...If he sent the demand two months ago, he would've/should've put a deadline on it. Have you asked your atty about this? I'd be putting the pressure on the person you're giving a third of your money to, and make him answer some questions.

A demand is just that... a demand. Only a judge/jury can state that the other driver/owner needs to pay a certain amount. If the attorney does not obtain a response he/she should call the adjuster to find out the status. Usually a demand gives the insurance company a time frame (usually 30 days... sometimes 2 weeks) to respond before suit is filed.

(Just a comment)..Sounds like the Atty isn't really keeping up with this situation. He should be givibg 'updates' what is going on. I would THINK, anyway.
