if you hurt your back at work and receiving treatment for it and has had surgery on it. and still is under w/comp dr. care. And one day u go into a store and slip on some water on the floor and hurt your back again report it to the manger. can u have a workerscomp lawsuit and then have a personal lawsuit because of injuring the same area. will that affect your workerscomp lawsuit.

I don't think it would be wise to file a claim under w/c again. Since you didn't get injured at work, I don't think you'll get compensation under w/c. You may file a suit against the store, but then you'd perhaps need to prove that it was the store's fault not to have taken care of things in a proper way!

Well, aren't we just happy to sue people

yes, but you will devalue both claims..will that affect your workerscomp lawsuit.
If I were handling the claim it would.Posted: Tue Sep 21, 2010 09:10 am Post Subject:

Yes we are..but then we need to be careful. If we're paying 33% of what we achieve towards attorney fees, then we ought to know the pros and cons beforehand. Some of us are being foolish at that.
