Insurance refuse to pay medical bills!

A car t-boned my car and I'm at a "no-fault" state NJ. I was the driver and my mom was the passenger. Both me and my mom went to the emergency. The policy is under me and I have my mom cover under my policy. I also have PIP as the primary. My auto insurance will pay for my medical bills but not my mom because they said my mom should cover under my dad. They were divorced less than 1 year ago and at that time, my mom has her own car and her policy. My insurance said my dad's auto insurance will still be responsible for her medical bill this time since the divorce is less than 1 year ago and they still shared the same address. What to do?

File the medical claim under your fathers policy. If your carrier is correct, your fathers insurance will pay... if not, they won't and you can go back to your carrier.

PIP coverage is odd.

Thanks for the quick reply. If they (my dad side) deny the coverage, I go back to my current carrier but can my carrier deny the coverage again? If such situation do occur, as the last resort, is it best to go to a lawyer?

Your carrier could... but I'm betting 1) your fathers carrier will pay the claim and 2) if they did not, your carrier would.

If either carrier won't pay the claim 1) ask them for a written denial and 20 ask if they will quote the part of the PIP law that is giving them the ability to deny the claim.

As I mentioned, PIP is weird. For example... in FL is you are a pedestrian and struck by a vehicle you get PIP from any resident relative with auto insurance.
