MVA Hand injury... How do I determine fair settlement

In 6/09 was rear ended. Small cuts, and bruises and sore back but also really popped the thumb on my left hand. Wasn't able to use it well for a few weeks. Saw Dr's but nothing but PT recommended... Year later the thumb has continued to bother me and I have lost some of the strength in the thumb as the joint pops and is unstable. Had it looked at by a specialist and he determined that it has the look of being arthritic now and said to get use to it as it isn't going away unless I want to consider surgery to clean up the injured joint . I am 51 and pretty active so this does and will continue to restrict activities that I used to engage in... Attempting to settle this but without engaging an attorney, I don't know what is fair. Any input? JW

51 and "active"... everything to do with the claim.

OP, no one at the insurance company has spoken to you for the past year? Were you treating this entire time? If not, why was an offer/demand not made? 51... my guess is that some arthritis already existed. If no treatment over the past year it's going to be difficult to convince someone that this started all of a sudden... a year later with no issues in between.

What state are you in? I'm concerned about the statute of limitations.

I have been treated throughout the year with the specialist making the last prognosis in May. There was no prior injury to this hand or thumb and there is no discomfort or joint instability on the right hand. I am right handed as well. I have been in contact throughout the year with the insurance carrier and until there was clarity that the problem was not going to diminish, didn't feel that the scope of the injury was clear. I reside in Oregon, and I understand there is a two year window to file a suit if necessary.

The injury to the thumb was noted on the first Dr. appt, 1 day after the accident. The door panel handle of the car that my left hand was holding to was torn away from the door and broken in half. I noted that it felt like my thumb had been sublocated and that after the accident, I had to relocate the thumb to use it.

Guest, read her post again, she didn't say she was 'attractive' she said she is a 'pretty active' 51year old...geeze the world is just full of haters and idiots isn't it? :roll:
