I was stopped in traffic waiting to turn left. BAM!! I got hit from behind. There is a witness, he stated that the driver of the auto that hit me was looking down at cell phone at the time of the accident. I had a 2005 Chevy Impala w/ liability only as I had the car sold. She had full coverage w/ State Farm ins. I fear that her adjuster is going to offer diminished value do to my car has a salvage title. I live in Wi. and understand that Wi. does not apply diminished value, I got that info from an auto body service writer. I am disabled,I have a below the knee amputation on my left leg, a trans metatarsal amputation on my right, i have chronic arthritus in my lower back and neck, and was greatly injured in the accident, trans ported by ambulance to the E.R. I've had a headache since the accident and the body pain is unreal. Do I have much to worry about as far as my auto value? Thanks for your help

That would be a good thing. Diminished value is added to your settlement as your vehicle is now worth less because it has recieved inherent collision damage. Your vehicle was totalled in this accident, or was it totalled in another incident and you decided to keep it? If that is the case, was this prior damage repaired? If not, that damage will be deducted from the current value of the car.

If that is the case, then you won't be recieving a DV settlement.

Possibly, but your information you provided is confusing. Please clarify why you have a salvage title.

The car was purchased at auction with light front cosmetic damage w/salvage title I spent two months repairing the car back to wonderful condition. I had the car inspected by the State of Wi. It passed that inspection deeming it safe for registration assignment. After this collision the car was considered a total loss.

There's no other option left, but the car has to be totaled now. It's a one of it's kind incident wherein you buy a car with a salvage title and then spend time and money to get it repaired.

Just because a vehicle is registered with a salvage title does not mean the next collision will result in a total loss. The cost to repair the new damage is always evaluated compared to the Actual Cash Value of the vehicle. If more than about 75%, then the vehicle will be "totaled" -- it still does not mean the vehicle is unrepairable.
