Geico claim

I got in an accident in Janurary of this year. The auto body shop I took it to did a bad job ($8100). Three months after I got the car back the air condessor went. I took the car back to Toyota and found out Geico used all aftermarket parts (which voided my extented warrenty). Totyota says it's going to cost around $7,000.00 to fix everything the original bodyshop did. Now that price is past the 75% or the appraised value ($16,500.00) Geico wants me to take the car back to the original body so they don't have total the car or pay $7,000.00 more just the difference in what they originall paid. They said they will pay Toyota to replace all the aftermarket parts but the original body shop has to do the work. I don't want them to touch my car again. So Geico tellls me that I will have to sue the body shop then. Doesn't Geico have to total my car out and pay me the difference? Isn't it their responsibility to recoup money from the faulty bodyshop since I pay them and they act as my broker?

Unless the aftermarket parts caused damage or failure of any OE (original equipment), the use of aftermarket parts will not void your factory warranty. Did the shop and or Geico fail to inform you either verbally or non-verbally (in writting/estimate) that these parts will be used.

Tell Geico to go jump in the lake, they don't own your car and cannot force you to go back the shop.

Nope, sorry. Is this shop one that Geico suggested? If not, what is this shop's warranty on repairs?

True to some extent. If this is a shop that you selected on your own and where not told to go there, you may have to take it up with the shop.

Yes and no. Did you recieve a check for the repairs from Geico or did they pay the shop directly?
