I was hit by a driver who ran a red light which ended up with my vehicle being totaled by Allstate. Doesn't Allstate have to give me a replacement vehicle?
Background: driver was not the owner, but the owner is insured by Allstate. My vehicle was 1998 Ford Sport Explorer with 306,000 miles. Very well maintained and still in excellent condition. Allstate wants to pay only a small amount. I can't possibly buy a comparable vehicle for that small amount. Why should I have to incur a financial hardship due to someone else's negligence? The driver was cited for the accident.

A rental car may be. Allstate's only responsibility is give you the actual cash value of your vehicle. You then can take that settlement amount and purchase a replacement vehicle.

If the amount Allstate is willing to offer has a comma in the check, take it and cash it before it cools off. If you could even find a "replacement" for your 12 year old vehicle with 300,000+ miles and in excellent condition, it would probably not cost more than $1,500.
Hope you weren't spending needless money on your own collision coverage for that vehicle.
And when it comes to the emotional attachment you obviously had for the vehicle, you can't even sue for that in Judge Judy's courtroom.

Thanks for your responses. Well - it didn't turn out well. Looks like the ins. co. gets to make $ on the salvage. It makes me sick that we took care of a vehicle and end up with a mere pittance. Expensive lesson learned - unfortunately the hard way.

Of course. You decided on a settlement amount for your vehicle, the insurer sells it at the current salvage value. It doesn't work any other way.

Here's a different analogy:
We spend years and countless dollars to care for and raise our children. Some of us even foot the bill for them to go to college and "earn" a degree.
And what do we get in return? A college graduate who moves back home for the free rent, utilities, groceries, and laundry service.
A mere pittance, indeed.
