For the last 10 years I have been backing into my parking spot at work. Yesterday while backing into my spot, a coworker decided to race behind me. I did not see him do this and as I was backing up I hit his vehicle. I admit I didnt look properly but also feel he was driving carlessly. am I at fault just because I was the on backing up?

Backing up or going forward, you have a responsibility to watch where you are going and make a reasonable effort to avoid a collision.

So, the answer to your question is, probably, yes.

yep, yes you are...sorry..let me ask you something...what part of your car hit what part of his/her car?

I agree with both Max and Lori... probably liable but what also needs to be considered is the point of impact to both vehicles. That is, should the other person have known you were backing up and put his car in harms way.

What state you are in also would come into play as negligent laws are different.
