Is an at fault insurance carrier required to pay for custom

Is an at fault insurance carrier required to pay for custom color paint and decals for a comerical truck when it has been determind to be totaled?

I have a trailer that was hit by another commerical vechile. The at fault insurance carrier has made an offer for ACV, which is less then the cost I have to pay to have a trailer painted and decaled to match the rest of my fleet.

It has alway been my beleive that when some one hit you it is there resonability to make you whole, but for me purchasing a like kind trailer with out my name an colored doesn't.

The ACV offered seemed to be veryresonable but like I stated it does not included paint and decals?

Just wondering if there are laws or gerenal practices that address this. (State NJ)

Yes.... it's part of the truck and part of your loss.

I agree 100%, 24 hours, 7 days a week.

If someone other then the adjuster inspected the vehicle, I'm betting that they never bothered to include this info. Photos would clearly show this but the adjuster may not even realize the mistake.

Have you called the adjuster and asked about this? I see no reason why they would refuse... as the owe you the cost to replace the vehicle with one exactly like it... which includes the color paint and decals.

I don't know of any adjuster that would not pay for this without any questions.

What is funny is i mentioned it to the adjuster when he came out to look at the damage. I also responed to their offer and asked for it to be considered, below is the response that they gave me:

This figure is for the actual cash value not the replacement cost value. The lettering unfortunately does not increase the ACV of the truck. If you’d like you can go through your insurance carrier and have them subrogate us. I believe the offer would be very similar if not the same. If you decide to go that root, if they send me your dec page, I would be happy to send your deductible to directly so you didn’t have to pay a deductible.

Any Thoughts?

I agree, but I don't really see the reason why an adjuster won't include it when he finally checks in.
