Hello, I was driving my wifes vehicle about a month ago now. I just got off of work and drove onto the interstate. When approaching the interstate change which was a Y looking section of the road both sides have 2 lanes. I remember looking back to get into the right lane(myself being in the passing lane) and put my right turn signal on to merge and saw a white vehicle in the distance approximately 20 feet away. As I started to merge I noticed that the white car sped up and it was to late at that point to get back into the lane so she hit my right front tire knocking me wildly back into my lane. We pulled over and I got out to ask her if she was okay and she replied yes, she then further was trying to explain to me how I hit her vehicle but there was no damage to my wifes truck. Her car door was scraped from the tire was all. The roadside assistance vehicle pulled up and gave us green slips to write down our information and he dispersed them. Afterward following the woman she drove her vehicle away as I followed behind. I get a phone call asking for my statement on the situation so I explained from my wifes insurance company and about a month later recieve a phone call explaining that this woman is trying to sue for medical expenses. First of all I left it up to her to decide if she wanted the police to come in which she replied no and we moved on. There where no signs of any problems while she drove away. The insurance company wants me to get pictures documented on my wifes truck and wants to see what may come of this but honestly there is no damage because she ran into the rubber part of the tire. What should I do in this situation? And how do you think the outcome should be from this situation and is it even going to get to the court room with no police report?

What did your insurance company ask you to do ( The insurance company wants me to get pictures documented on my wifes truck)? That is what I'd recommend doing.And how do you think the outcome should be from this situation and is it even going to get to the court room with no police report?
Nothing goes to court unless a party files a lawsuit. This seems far from that.What will happen depends on the other person's statement of what happen, her documentation, the photos from your vehicle and the other person's, etc. There is simply no way to tell what will happen with the limited information you provided. I can say that the point of impact being to the side/front of your truck indicates that you changed lanes into her and that she had established herself in that lane. You mention that she was 20 feet behind you when you looked but you don't comment on her moving much faster then you... which appears was the case in order for her to gain 30 feet or so in the time it took you to start changing lanes. Also, it appears when it were moving into the other lane that she was already there.
Your carrier will apply state laws and other settle the claim with a payment or deny the other person's claim and provide you a defense. Feel free to call your adjuster and ask how they feel about the claim.

Yes, you probably need to provide us with more information. If your carrier provides you with a defense, then I hope it's not too bad for you.
