during the restoration of our garage damaged by a fire,the farmers insurance adjuster cuts a check and mails it to us.its for a work change order we had not signed for or new of at all,adding $18,000.00 more to the contract.we found out later the adjuster and the contractor doing the work are old friends.our policy for the whole house maxed out for the garage ,so our contents in the garage wasn't fully covered total cost for the garage =$107,000.00 numerous prices are falsly entered in the xactimate estimator used in the contract /change order.is this fraud with insider help?

You have a house with an attached garage, the garage cost more then $107k to rebuild and your policy on the entire home has a limit of $107????? I'm guessing your home is worth more then your garage? If so, you were/are _incredibly_ under insured. So much so, you'd certainly have less then 80% of the homes value insured. This would mean you'd not meet the co-insurance factor so you should only be paid actual cash value. Is this correct? I fail to see how you could be so under insured.

Are you also saying that there was not $107k in damages to the garage? I'm guessing you picture the contractor. Why not have another contractor review the Xactimate estimate to see if it's correct. Why do you think it's too high? That is, what are you basing your opinion on?

What you are saying makes no sense anyway. If your entire policy limit is $107k and this was paid, then it would not matter if they paid $107k for the repairs to the dwelling or $100k for the dwelling and $7k for your personal items... if your policy has a $107 limit... then this is all you will be paid regardless.

Maybe so, but if the structural damage was only $89,000, there would be $18,000 available for personal property. I think what the OP is hinting at is there is some sort of collusion between the contractor and the adjuster -- inflating the claim to the contractor and reducing the compensable loss to the insured for personal property.

If so, that would constitute insurance fraud on the part of the contractor and adjuster. The OP, however, would have to have better proof.

In regard to the valuation of the garage, it could be detached and therefore covered as an "other structure" with a considerably lower limit than if it were an attached garage. The OP's description of the loss is sufficiently vague to know for sure how the garage is covered.

I would certainly agree that total coverage of $107,000 does not sound like reasonable coverage for something other than a fancy tent.

what i was inquiring about is the adjuster cutting the check for a work change order a full 10 days before we even seen it or signed it .i believe being its our policy not the contractors or hers shows they are not following proper procedure.the xactimate sheets list some false prices such as a8"x16"x20' timber beam costing $976.00 ,I checked dixieline price the counter man winced telling me its special order and would cost $522.00 what was installed was a 4"x14"x20' beam with a cost of $129.00 thats just 1 of many, using 16" o.c. spacing for joist and rafters instead of 24" and calculating the installment labor as a part of the material cost ,then seperately charging all framing hours ,you can tell when she uses sq ft instead of linear ft .double entry of the same work in different sheet heading is another trick- painting the same doors in "garage then again in "front elevation"used numerous times ,its really easy to see ,I questioned her about the beam and joist spacing and she replied sometimes we add things to cover other areas, i told her its all over covered ,she didn't respond instead she depreciates teak wood that was stored for future projects by %90, how did it get wear from use ?the policy was for $187,000.00 .she depreciated the hell out of the contents many antiques that took 20 years to find became worthless .these two criminals should be in prison
