insurance com. issued check to both of us. But I am behind 3 years worth of payments and would like to get the house caught up. Can they automatically take those payments with out asking and then use the rest of the money to fix the house?

NO. The two issues are unrelated. They are only entitled to the money to the extent repairs to the dwelling need to be made and you refuse to make them, like you are refusing to pay your mortgage payments. I can't imagine a lender has allowed you to get this far in arrears.

Can it actually go this far? Don't you think 3 years is a pretty long time for this to happen? I guess, we're yet to know a few other things that may have happened!

In today's environment, anything beyond 6 months is probably going to foreclosure. If someone is three years in arrears, the lender is either asleep or out of business.
