I have contacted them several times since being released from Doctors care but they dont seem to be doing anything to resolve this claim. It really seems to me that they are dragging their feet. Is there anything I can do to speed up the process?

I give up... what type of claim is this? I'm guessing some type of auto claim since this is where you posted. If so, is it a 1st or 3rd party claim.

My first question is always... have you called them? What did they tell you the status was?

My second recommendation is always to file a complaint with your states Dept of Insurance office. They can look into the matter.

This is injuries suffered from a motorcycle accident. The other drivers fault. I have called numerous times and feel like I am being brushed off. I have thought about the state insurance commission but was hoping to use that as a last resort.

Are you all done treating? If so, fax or send them a demand
(with a dollar limit) in writing and/or fax it. In the letter give them 14 or 30 days to make an offer.

When you call, leave a message. If they don't call you back by the following day, call and speak to that person's supervisor. If you leave a message and they don't call you back, call that supervisors supervisor. Explain to each one (in the message if you leave one) that you have left a message already for the prior person and they never called you back. In all the companies I've every worked for, if an employee gets a few complaints for not returning calls, they are usually put on probation and then fired.

Why use it as a last resort? Call them now and start the process.

Your last resort is an insurance bad faith attorney. Your BEST resort is the Dept of Insurance, because you pay for their services with your premium dollars and taxes, and their services are free.

File your complaint in addition to following tcope's advice to keep up the barrage of phone calls to the toll-free phone line. At this point, I would head directly to the supervisor -- and demand to speak directly to them, not to voicemail.
