Is a contractor concidered making insurance fraud if...

The insurance company paid us and we deposited the check into our bank had a check made out to the contractor and (the contract was signed in my home& he was paid)he cashed the check and didn't do any work on our home, I know this is contractor theft/fraud but is it also a form of insurance fraud?

No, it is not insurance fraud. It is "breach of contract". You should file a complaint with the contractor's license regulator and sue the contractor in small claims court if the amount is under the limit for that venue.

The reason it is not insurance fraud is because the contractor had nothing to do with the insurance claim. Only you did. As long as you had no intent to conceal, misrepresent, disguise, or deceive the insurance company, there is no fraud involved.
