Can an employer cancel your health insurance without notice

For example, a phone call was received today and we were advised the cancellation was effective Saturday 10/9/2010. The policy covers our children who are playing sports so I have a real concern about this. Thank you.

If an employer is terminating a group health plan with respect to all employees, it would be a courtesy if the employer gave prior notice. Assuming your employer has 20 or more full time employees, ERISA provides that employees (and their dependents) in such a case are to be given 31 days to covert to an individual plan of insurance without proof of insurability.

On the other hand, if the employer has failed to pay premiums, you would probably not receive advance notice.

Unless your employment is being (or has been) terminated, your employer is generally prohibited from discriminating against any particular individual by terminating their coverage. If you believe this is the case (and your employer is subject to ERISA), you should file a formal complaint with the US Dept of Labor, Employee Benefits Security Administration. Your local office can be located on their website http://www.dol.gov/ebsa/

i got hurt going to work.but before that i had gotten hurt at the job. because of this recent fall, i have not been able to go to work and now i need surgery on my shoulder whice was related to my fall at the job, i received a phone call freom my boss telling me that my insurance has been terminated. can they do that?
