Involved in an incident where I was 100% at fault, the only thing is I am damaged as well as the other party. How do I deal with the insurance company who insist I help with the investigation to defend against other party claims when my damages are also at risk? The insurance company is trying to get out of paying either claim and there is no one else to hold responsible for the damages if they get out of it. Other parties damages could be in excess of my policy limits. I can't be a witness for both (me & insurance company).

In what way are your "damages also at risk"? Not that I understand that statement. You state that you were 100% at fault. In what way are they asking you to help with the "investigation"? You do have a duty to cooperate with your insurance company. This is part of the insurance policy/contract.The insurance company is trying to get out of paying either claim and there is no one else to hold responsible for the damages if they get out of it
How are they "trying to get out of paying either claim"? Either? If you were 100% at fault why would there be more then one claim? You also state that there is no one else to hold responsible if "they get out of it"... as if the insurance company was the negligent party.I can't be a witness for both (me & insurance company).
If you care to provide _any_ information on what the situation is, this might make a little sense.Add your comment
