my nissa xterra 2008,got 10,000.00 damage done to it the guy ran a red light has giego ins. do i have any right to have it totaled,i really do not want it back,he knocked off my rear end which yanked off the transmisson out of the engine an afew others thing got damaged,but his ins. co said they cannot total it,can i not request it to be total ,also this does bring done the vaule of my car..?

Do you have a right to make the insurance company pay more then the cost of repairs if it's more then the value? No. This is actually what you are asking. If the vehicle's value is $15,000, the repair cost is $10,000 and you don't want it... don't have it repaired (providing you don't have a lien holder), sell it and buy a different vehicle. It's the same outcome in the long run. If their is a lien holder this won't work unless you pay off the lien and then sell it to buy another.can i not request it to be total
No... as it can be repaired to put it back in the same condition it was prior to the accident.,also this does bring done the vaule of my car

I'd certainly have a post repair inspection done of the vehicle by a different (non affiliated with the insurer) qualified shop to determine whether pre loss condition was achieved in their expert opinion.
