driver A wasn't wearing a seat belt, when he was rear-ended

Driver B neglected to notice that light had turned red and that driver A in front of him had also stopped at said light. B admitted fault, though no-fault state.
A had seat belt slipped over arm, but not entirely fastened. the impact caused great tension on A and forced him to push himself back into seat and grip wheel. No serious injury apparent, but seeing medical as precaution.

Translation - I was too lazy or did not want to mess up my threads to put my seat belt on. Some meat head hit me in the rear. Will the insurance company hold it against me that I was slightly hurt since I didn't have my seat belt on.

My follow up question will be........(DING DING DING) how much is my claim worth. I have one doctor visit, 5 months of chiro at 6 times per week and an RX for some Flexeril.

And the bonus (or BONEHEAD) question to ask: Did this incident happen in any of the few contributory negligence states?

Or in Jeopardy! style: Bonehead for $1000 When a driver is one percent involved in his own injuries by not wearing a seat belt as required by law, and the accident occurs in a contributory negligence state.

Answer for $1000: "What is: The bonehead who got rear-ended by the meathead will not get to recover any damages for his medical expenses?"
