I said most in the question, but it looks like it only accepted 60 characters. I'll start where it stops--They said we had the "opportunity" and "means" to have set the fire. State Farm has no evidence to back up thier statements and also misquoted 10 statements from our recorded depositions, to make them sound like we said something different. I have the real statements from thier attorny. I filed a complaint to the NCDOI and State Farm sent them a letter saying they were paying off our mortgage, but they never told us. Our policy is for $475,000.00 We requested $425,000.00 Our mortgage is $83,000.00. Thank you for any help you may have, we don't have much money and State Farm knows this.

What help do you need? You have only made a statement. It sounds like they are going to pay the claim.

Since the claim was declined. I guess I need an attorney. Back when I wrote this I was just complaining about state farm not having any evidence to back up their claim that I set the fire at my own building. I didn't ever expect any help or any good advice to come from a free site like this one, anyway.

Since the claim was declined.
If an insurance company "declines" a claim they are not usually making a payment.Please explain in more detail.

We were sent a letter from State Farm Nov. 9 2010 saying they were not paying our claim because they believe we set the fire at our home on June 5, 2010. I then made a complaint to the NCDOI the next day. Nov. 16, 2010 State Farm replied back to NCDOI and said they were not paying me any money but they were going to pay the mortgage off ($83,000). If State Farm beleives I set the fire, why will they pay of the mortgage. I contacted Suntrust mortgage today and they have not been paid off yet. State Farm said Quote"State Farm is proceeding to honor it's obligation to th mortgage company listed on th policy by soliciting their claim and hope to have that matter resolved in the coming weeks" Thanks Jeff Gray

While anything is possible, I kind of doubt this was a denial or that they stated it as you mentioned. I've _never_ heard of any insurance company denying such a claim because they "think" the person started the fire. They all know that they need a _lot_ more information then that in order to even think about a denial.State Farm replied back to NCDOI and said they were not paying me any money but they were going to pay the mortgage off ($83,000)
There is _still_ a ton of information I feel you are leaving out. SF just came up with a made up number to pay on the claim? Why only the amount owe on the loan? Surely they explained this to someone.Here is what I think more of the story is....
SF denied and is still denying your claim based on some action you took. Perhaps they have enough info to prove to a judge or 7 people that you had something to do with the fire... perhaps they asked for an Examination under Oath and you missed it (an EUO is almost always done in these cases). As such they are denying your claim under the terms of the policy but since your mortgage company cannot be penalized for your actions, SF is paying only your mortgage company the amount they are owed.

Hi, To begin Thanks for your time. Of course there's a lot more to the story. On paper my story is about 1 1/2" thick. I have copies if you want one. State Farm never told me they were paying any of the claim, I was told this and sent their reply from the NCDOI. My wife and I both had seperate depositions, not one of our answers were different. State farm has not one piece of evidence to back up their claim. graydesign64@yahoo.com
