We had a house fire on Aug. 20,2010 due to two men with mask and gloves broke in, beat me up, strangled me till I passed out. They stole money and jewelry. When I woke up the house was on fire. The state fire marshal, county investigator is still investigating. Also, the insurance company has still not settled. They ask for one thing then wait week then ask for another then wait weeks, and it just keeps going on. We have given them all of the information that they have ask for when they asked for it, all we get when we ask why it's taking so long, they continue to say the claim is still open. Like we don't know that. They have sent us a Reservation of Rights Letter telling us their taking another 60 days to investigate, yet there is nowhere in our policy where it says they can do that. What it does say is that they will pay within 60 days. The crime is still under investigation by the State Fire Marshal and according to them it is going to be an up hill climb since we can not identify the men. How long can the insurance company keep this up?

What about the cause of the fire? This would be a key in resolving the claim and getting it closed. If the cause has not been determined, then the insurer continues to investigate, may ask for more information from you, experts etc. They don't need to identify the "men", if it is clear that someone or something other than you caused the fire.
How long can the insurance company keep this up?
Depends on the circumstances. There seems to be somethings you left out of your statement or the insurer believes there is reason to continuing the investigation. Whatever that reason(s) would be is what is keeping the claim open. I would ask them to give you some sort of a time frame and keep in contact with authorities.
